Warranty Deed to Trust

A warranty deed is a legal document used to transfer real property from one party to another, with a guarantee that the property title is free from any defects or encumbrances, except those specifically listed in the deed.

MI Easy Forms warranty deed is designed for transfers of real property into a trust.

You do not have to use a warranty deed to transfer into your trust. However, if there is title insurance on your real property to be transferred into your trust, it may provide the title insurance protection with the transfer. However, if you want to be sure you have title insurance coverage after the transfer into your trust, you should contact the title insurance company.

You will need the following information:

  1. Name and address of the Grantor(s) (person(s) transferring ownership).
  2. Name and address of the Trust and Trustee(s).
  3. Date of Trust.
  4. Township and county where the property is located.
  5. Legal Description of the property to be transferred.  You can normally find this information on the current deed or a survey.
  6. Tax parcel number (may be found on a tax bill).                      
  7. Whether the property is a condominium or platted (platted property is generally described as lots and cannot be divided into smaller acres or lots).
  8. The number of land divisions you are granting to the Grantee(s). (all, zero or specified number).
