TERMS OF USE AND DATA PRIVACY FOR
MI EASY FORMS DOCUMENT PREPARATION SERVICES

MI Easy Forms, LLC (“MI Easy Forms”) is a Michigan based company. It offers Michigan residents access to a repository of Michigan court templates and related legal documents commonly used in Michigan legal matters and proceedings like divorce, guardianships, conservatorships, name changes, wills and estates, and other similar legal matters. MI Easy Forms legal document templates have been reviewed by a retired Michigan Judge and practicing attorney.

MI Easy Forms goal in providing access to these court templates and related legal documents is to help you better understand the legal process and put you in the driver’s seat of your legal matter. This empowers you to focus on managing the other parts of your case, reduce or eliminate legal fees paid to an attorney, and help you avoid having a judge reject an improperly prepared or incomplete court filing.

To achieve this goal, however, users of this site (“User”) should understand that while MI Easy Forms document preparation services allows users access to templates and other legal documents, such access should not be considered a substitute for full representation by an experienced and licensed attorney to address all phases and considerations of the Customer’s matter.

It is also important to acknowledge and agree that in exchange for access to the information and services provided by MI Easy Forms through its Website, the User must agree to these terms and conditions (“Terms of Use”) as well as agreeing to become a Customer under MI Easy Forms agreement for services. Without agreement to these terms and conditions the services provided by MI Easy Forms and made available to on this Website would be materially different or not offered at all.

AGREEMENT BETWEEN USER AND MI EASY FORMS

By using and accessing this Website, User represents and agrees:  User is at least 18 years old;  a resident of Michigan;  is legally able to enter into this agreement;  User understands and accepts these Terms of Use;  User agrees to use this site and any services for User’s own use and not for any commercial purposes; and  if a User hires MI Easy Forms User will also become a Customer and be subject to these terms and MI Easy Forms agreement for document preparation services.

By using and accessing this Website, its contents, and products, User acknowledges and agrees: MI Easy Forms contents, instructions, and products are a “Do it yourself” process and is not meant to be a substitute for legal advice; The use of MI Easy Forms does not create an attorney-client or confidential relationship, or privilege between the User and MI Easy Forms or Lahti Legal Services and its attorney(s); Lahti Legal Services and Shana Lahti are not prevented from representing an adverse party in an action to the DIY process purchased by the User; MI Easy Forms is not a law firm, or an attorney and the services provided are not legal advice or a substitute for services of an attorney.

Limited License and Customer’s Responsibilities

MI Easy Forms is not a law firm, it is not providing legal advice, and it offers no legal services. Instead, it offers its customers the opportunity to use its automated software solution for those who choose to prepare their own court filings or other legal documents for probate and family law matters including but not limited to divorce, name change, guardianship, conservatorship, power of attorney, wills, and pet trusts, or other domestic relations legal issues that are filed in Michigan State Courts.

MI Easy Forms will grant Customer limited permission and a limited, personal, non-exclusive, non-transferable license to use and download document templates purchased by Customer. Each such documents may be used only by Customer and for Customer’s non-commercial use. Customer is expressly prohibited from reselling, distributing, or otherwise sharing any legal document or court filing obtained from MI Easy Forms without its written agreement. MI Easy Forms will be entitled to all damages and costs, including its actual legal fees or the monetary value of MI Easy Forms time spent for preparing or pursuing any action involving Customer’s breach of this paragraph.   

Any legal document template Customer pays to access will be prepared based on information the Customer provides. Customer agrees not to input any content or information that is false, threatening, advocates for or involves conduct that may constitute a criminal offense, or that violates any third-party’s copyrights, trademarks, or other intellectual property or proprietary rights. Customer will be solely responsible for any violations stemming from content or information Customer provides that violates any of the preceding or other relevant laws, including infringement of third-party rights stemming from any content or information Customer provides to MI Easy Forms.

Signing MI Easy Forms service agreement will represent Customer’s agreement to carefully review the final draft of any document prepared through MI Easy Forms site and that to the best of Customer’s knowledge the content of the document to be prepared will be  accurate;  based on facts known to Customer;  consistent with existing law or a reasonable argument for extending, modifying, or reversing such law; and  submitted for a proper purpose and not for harassment, to cause unneccessary delay, or increasing the cost of litigation.

All court filings prepared through MI Easy Forms must be signed by Customer before filing with any court and will not be signed by MI Easy Forms. If you do not understand the topics discussed in this paragraph, please talk to an attorney.

Any alteration of documents prepared through MI Easy Forms services may terminate Customer’s permission to use such document, as well as causing Customer’s document to be rejected by the judge assigned to Customer’s legal matter. Any unauthorized use of documents prepared by MI Easy Forms may violate Michigan or federal law, including copyright and trademark laws.   

Customer also acknowledges and agrees that MI Easy Forms will not make any appearance in Customer’s legal proceeding;  it will not review Customer’s answers for legal sufficiency;  it will not offer any opinions or recommendations about Customer’s legal rights, remedies, litigation decisions, strategy, claims or defenses, selection of forms, or application of the law to the facts of Customer’s particular situation;  It will not offer any opinion or advice for complying with applicable statute of limitations, court imposed deadlines, court orders, or other filing requirements; and  Customer acknowledges and agrees Customer is not relying on any advice, recommendations, or actions of MI Easy Forms that are not expressly identified in the Customer’s services agreement.

MI Easy Forms has taken reasonable care to prepare court approved or generally acceptable court filings or other documents. And MI Easy Forms takes reasonable steps to update these documents so they are current with applicable filing requirements. However, MI Easy Forms cannot guarantee any of its court or other legal documents will result in a particular future outcome, be free from mistakes, accepted by a judge, or appropriate for Customer or User’s particular circumstances. MI Easy Forms need not notify Customer about changes or updates to any of its court filing or other documents available on its Website. All such documents are provided on an “as is basis” with no warranty, express or implied, that any documents made available to Customer will be appropriate for your matter.

Also, MI Easy Forms will not normally review information provided by a Customer for accuracy, completeness, to correct spelling errors, or to correct grammar. Instead, Customer is responsible for providing complete and accurate information and reviewing it for spelling or grammatical accuracy.

Customers must strictly comply with applicable state or federal laws and court procedures that may apply to their legal matter. Customers must also ensure that all information provided for inclusion in any document prepared by MI Easy Forms service complies with applicable privacy law or regulations, including those affecting the disclosure of social security numbers, contact information, personal information about minors, and so forth.

Customers and users are encouraged to review the Michigan Court Rules and any practice procedures, guidelines, or other requirements that may apply to their matter, including by the judge assigned to preside over the matter.

If you need legal advice outside of your services agreement or if you find your legal matter has become too complex to be addressed by services or on your own, you should consult a licensed attorney in your area.

Referral Fees or Affiliate Marketing Programs

MI Easy Forms has a business relationship with Lahti Legal Services, PLC, a Michigan based-law firm, to provide limited scope of legal services to MI Easy Forms Customers if they decide to retain Lahti Legal Services, PLC.

MI Easy Forms may also provide links or referrals to other attorneys, law firms, or service providers using affiliate links or other referral services. These affiliate or referral programs may result in MI Easy Forms receiving compensation from attorneys or businesses not otherwise employed by or associated with MI Easy Forms. 

No Guarantee to Access the Website 

MI Easy Forms may change its Website at any time without notice. MI Easy Forms does not and cannot guarantee its Website and Services will function without interruption or in an error-free manner (collectively “Interruptions”). Such Interruptions may occur due to routine maintenance, updates, or system or network failures. If reasonably possible, MI Easy Forms will endeavor to provide notice of any Interruption within its control and to reasonably identify and resolve any unscheduled Interruption as quickly as is reasonably possible, as solely determined by MI Easy Forms. In any event, User agrees that under no circumstances and regardless of the legal theory or whether MI Easy Forms had been informed of the possibility of such damage or damages, MI Easy Forms is not liable for:

1. Any damages caused by any Interruption, including for loss of data, or services, or from the inability to use MI Easy Forms services or its Website.
2. Any damages caused by any Interruption relating to the use of MI Easy Forms Website or services.

Further, MI Easy Forms disclaims all liability for all damages caused by any Interruption, as well as any liability for slow, malfunctioning, inconsistent, or impossible access conditions of MI Easy Forms Website, Services, and Content Services for any reason.

DATA PRIVACY AND SECURITY

MI Easy Forms is a Michigan based company. It focuses on providing services to Michigan residents access to document templates common in Michigan probate and family law legal issues. It does not conduct business outside of Michigan. MI Easy Forms services are not intended for anyone under the age of 18. MI Easy Forms does not target an audience outside of Michigan and specifically does not target audiences in California, Virginia, Colorado, Europe, or other jurisdictions who may be subject to specific privacy or data related laws, including the California Consumer Protection Act, Virginia Data Protection Act, Colorado Privacy Act, or the EU General Data Protection Regulation (“GDPR”).

Third-party sites you may access through MI Easy Forms Website are not subject to this privacy policy.

Data Security Precautions

MI Easy Forms uses a variety of data security practices to help ensure as much security as possible. While there is no such thing as perfect data security, MI Easy Forms takes reasonable precautions to encrypt and secure its Website and secure information from users and customers. To the best of MI Easy Forms knowledge, any third-party data hosting we use also employs reasonable data security protocols and encryption.

Collection and Use of Personal Information

When a User fills out any form on this Website, such as to request a consultation, subscribe to our alerts, our newsletter, make a payment, or create an account with MI Easy Forms, we may collect and retain the information you enter.

Except as provided below, all information MI Easy Forms may ask you to input or provide through its Website will be kept confidential. And it will be used only in relation to provide User access to generate the legal document template the User purchases access to.

MI Easy Forms takes reasonable steps to protect your privacy, including information you are asked to provide through its Website. The information Customer is asked to provide for inclusion into a document template will be used only for that particular document.  

Additionally, when you visit MI Easy Forms some information about your computer and about how you use the site may be automatically collected. This may include your computer’s IP address, information about your web browser and operating system, and if you arrived at MI Easy Forms by clicking on a link on another Website, we may get the URL of the linking page.

Information that is automatically collected will be presented as anonymous or aggregated information and will not reveal any personal facts about individual users or their legal matters.

We may use information automatically gathered from visiting the Website to help improve our services and offerings to users, including by:

• personalizing content you see;
• increasing equal access to justice;
• inform our strategic development for expanding services or improving the services we provide;
• ensure our site is compatible with the technology used by visitors;
• notify you of relevant news, services, or other alerts MI Easy Forms may provided from time-to-time (unless you opt out of receiving such information); and

We will try to update you when such changes happen, but will not always be able to do so. Digital Millennium Copyright Act (DMCA)

If User believes any material on the Website, either posted by MI Easy Forms, our users, or any other party, is infringing, please contact MI Easy Forms at the address below. Under the Digital Millennium Copyright Act, MI Easy Forms has a designated agent to receive copyright infringement claims.

MI Easy Forms policies relating to copyright are stated in these Terms of Use. The Digital Millennium Copyright Act generally requires that all infringement claims must be in writing and must include the following information:

• a physical or electronic signature of the copyright owner or the person authorized to act on its behalf;
• a description of the copyrighted work claimed to have been infringed;
• a description of the infringing material and information reasonably sufficient to permit MI Easy Forms  to locate the material;
• your contact information, including your address, telephone number, and email;
• a statement by User that User have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
• a statement that the information in the notification is accurate, and, under the penalty of perjury, that you are authorized to act on behalf of the copyright owner.

This is not an exhaustive list and you should consult your own legal counsel or see Section 512(c)(3) of the Digital Millennium Copyright Act if you are interested in issues under this law.

Children’s Online Privacy Protection Act (COPPA)

In compliance with the Children’s Online Privacy Protection Act (COPPA), MI Easy Forms Website is not intended for audiences under the age of 18 or to collect any Personally Identifiable Information (PII) from anyone under 18 years, unless it is provided by the minor’s guardian or parent and we believe such collection to be permitted by law. If a User is the parent or guardian of a child under 13 and it is believed that the child has disclosed PII to MI Easy Forms, please contact MI Easy Forms at [email protected].

Upon request, the parent or guardian of a child under 13 may review and request the deletion of such child’s PII, as well as refuse to permit the further collection or use of such PII.

Miscellaneous Legal Provisions

By using this Website, as well as any information found on this Website, users, and customers expressly understand and agree to the following:

1. Complete agreement: User agrees that the Terms of Use constitutes the entire, complete, and exclusive agreement between User and MI Easy Forms about the Services and supersedes all prior agreements and understandings, whether written or oral, or whether established by custom, practice, policy, or precedent, related to the subject matter of this Agreement.  
2. Binding on User’s Successors: This Agreement and its performance will be binding on User and User’s heirs, administrators, successors, and assigns;
3. Assignability: User may not assign or delegate any rights or obligations under the agreement, without the prior written approval of MI Easy Forms. Any purported assignment and delegation will be ineffective. MI Easy Forms may freely assign or delegate all rights and obligations under the agreement, including any License granted to MI Easy Forms under the agreement, fully or partially without notice to User. MI Easy Forms may also substitute, through unilateral novation, effective upon notice to User, MI Easy Forms for any third-party that assumes our rights and obligations under this agreement.
4. Equitable Relief: User irrevocably waives any right to seek injunctive or equitable relief. Accordingly, User will not seek or be entitled to rescission, injunctive or other equitable relief, or to enjoin or restrain the operation of MI Easy Forms Website or its Services, exploitation of any advertising or other materials issued in connection of either, or exploitation of the Website or Services or any content or other material used or displayed through the Website or Services.
5. No Waiver: Any delay or failure on the part of MI Easy Forms to exercise or enforce any rights under this Agreement to which it may be entitled will not, under any circumstances, be construed as a waiver of the right and privilege to exercise or enforce any such rights at any subsequent time.
6. Modification: The agreement and its Terms of Conditions cannot be amended, modified, or supplemented in any respect except in writing by MI Easy Forms. MI Easy Forms may modify this agreement at any time and such modifications will be effective after posting of the modified agreement and User’s continued use of the Website or Services means that User has agreed to accept any changes or modifications made by MI Easy Forms. User should periodically visit this page to review the most recent Terms of Use. If a User or Customer does not want to agree to changes or amendments to the agreement, then they should no longer use this Website or the services. 
7. Statute of Limitations: User agrees that regardless of any statute or law to the contrary, any claim, or cause of action resulting from or related to use of the Website or these Terms of Use must be filed in a court of applicable jurisdiction as specified in this Agreement within one year after such claim or cause of action arose or be forever barred;
8. Disclaimer: MI Easy Forms expressly disclaims all warranties of any kind, whether express or implied related to this Website and any content provided on the Website as much as the law allows. This disclaimer includes without limitation and by way of example only, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Except as such disclaimer may be limited by applicable law or as otherwise stated in this agreement and its Terms of Use, MI Easy Forms makes no warranty through this Website as to any information or other material obtained by User through the Website will meet User’s expectations. No advice or information, whether oral or written, obtained by User from MI Easy Forms or its Website will create any warranty not expressly stated in these Terms of Use. Any product or services purchased in relation to MI Easy Forms Website is done so at User’s own discretion and risk. 
9. Limitation of Liability: Some jurisdictions may not permit the limitation or exclusion of liability in contracts and, as a result, some or portions of this Agreement may not apply to User. But to the extent legally permitted under applicable law, User agrees that under no circumstances will MI Easy Forms, its subsidiaries, affiliates, directors, employees, independent contractors, agents, or any other party designated by MI Easy Forms as affiliated with its business operations be liable, without limitation to User for any indirect, incidental, special, consequential, or exemplary damages. By way of example only, this includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses. If for any reason this provision is prohibited or limited then, instead of this limitation of liability provision, User agrees that MI Easy Forms will be entitled to the maximum disclaimer, limitation, or both on damages and liability available at law and equity. User agrees that this limitation of liability release is made with the knowing intent of releasing all known and unknown claims in future claims and with the intent of waiving all rights under applicable statutes requiring such waivers to be knowingly made. User further agrees that MI Easy Forms will not be cumulatively liable for any damages in excess of any fees a Customer paid to MI Easy Forms for any services, or $500.00 (U.S.), whichever amount is greater. User further agrees that this limitation of liability is part of the basis of the bargain between the Parties and without it the terms and fees charged would be materially different. User also agrees this limitation of liability will apply regardless of whether (i) User bases User’s claim on contract, tort, statute or any other legal theory, (ii) MI Easy Forms knew or should have known about the possibility of such damages; or (iii) The limited remedies provided in this section fail of their essential purpose; and; (iv) MI Easy Forms may cause User to be damaged intentionally or knowingly in violation of this Agreement or applicable law, or as otherwise mandated by applicable law that cannot be disclaimed from in this Agreement.
10. Choice of Law: User agrees that any dispute arising in any way from your purchase of any Services or Subscription Agreement, access to the Website, your use of the Website, or a violation of the Agreement are to be construed, governed, and enforced exclusively according to the laws of Michigan or applicable federal law, such as copyright, patent, or trademark law, without respect to its conflict of laws principles.
11. Language Translations. If any translation of the English language version of MI Easy Forms Agreement, the Privacy Policy, or any other documentation is provided or otherwise made available to User by MI Easy Forms or any third-party service provider, User agrees that the translation is only provided for User’s convenience and that the English language version of this Agreement, the Privacy Policy, and any other documentation will control and govern User’s relationship with MI Easy Forms.
12. Jurisdiction: This Website is controlled and operated by MI Easy Forms from its offices within the State of Michigan.User or Customer’s use of this Website or any claim, cause of action or dispute resulting from or related to the Website and any content, company, or service provider found on the Website, as well as these Terms of Use (collectively “Claim”) will be governed by the laws of the State of Michigan regardless of User’s state or country of origin or where User accesses MI Easy Forms Website, and notwithstanding of any conflicts of law principles of your geographical jurisdiction and the United Nations Convention. If User access this Website from any location outside of Michigan, User do so on User’s own initiative and is responsible for compliance with User’s local laws, if and if they are applicable. User agrees that use of or access to the Website will not be construed as MI Easy Forms purposeful availment of the benefits or privilege of doing business in any state other than the State of Michigan. Further, MI Easy Forms does not consent to personal jurisdiction in any other state except Michigan and User agrees to not assert such jurisdiction in any other state except Michigan. Further, User agrees that a competent court in Michigan will have exclusive jurisdiction over any dispute arising in any way from User’s use of the Website or Services, or a violation of the agreement’s Terms of Use. User agrees not to contest this exclusive jurisdiction. User also agrees that to resolve any issue about conflict of laws that may arise, the Terms of Use will be considered fully and solely executed, performed, and observed in the State of Michigan.
13. Limitation on Access and Distribution: The information provided on the Website is not intended for distribution or access by any person or entity in any jurisdiction or country where such distribution or use would conflict with law or regulation, or which would subject MI Easy Forms to any registration requirement within such jurisdiction or country.
14. Severability: If any provision of these Terms of Use is found to be unlawful, void or for any reason unenforceable, then that provision will be considered severable from the remainder, which will remain in full force. The User agrees that any court, arbitrator, or factfinder should endeavor to give the fullest possible effect to the intentions reflected exclusively in the provisions of this agreement and its Terms of Use and should not affect the validity and enforceability of any remaining provision.
